Terms of Service

These Terms of Service ("Terms") govern your use of IPTinCan — the IPTinCan desktop and mobile applications, the iptincan.com website, and our managed server hosting service (together, the "Service"). By creating an account, purchasing a license, or using the Service, you agree to these Terms.
1. What IPTinCan is
IPTinCan provides private voice, video, and messaging servers. Each managed server is a single-tenant, private server operated for one customer (the "Server Admin"). The Server Admin controls who can join their server by issuing invites. We also publish software you may self-host free of charge, which is covered by its own software license rather than the hosting terms below.
2. Accounts and invites
- A managed server is created by a Server Admin who purchases a license. The Server Admin is our customer and is responsible for their server and the people they invite to it.
- Members join a server only through an invite issued by its Server Admin. If you joined via an invite, your relationship is primarily with that Server Admin — they control your account on their server, including removing it.
- If children use a server, the Server Admin (typically a parent or guardian) is responsible for inviting them and consenting to their use. See our Privacy Policy for how we treat children's data.
3. Billing
- Paid plans are billed through Stripe on a recurring basis at the price shown at checkout. Trials, when offered, convert to paid unless cancelled before the trial ends.
- You can cancel any time; your server remains available until the end of the paid period. We do not prorate partial periods unless required by law.
- If payment fails or a license is cancelled, your server may be suspended and later deleted (see Data Retention below).
4. Your content
You (and your server's members) own the content sent through your server — messages, recordings, files, and media. We claim no ownership of it. We process it only to operate the Service (see the Privacy Policy). The Server Admin can export, delete, or manage server content.
5. Acceptable use
You agree not to use the Service to:
- break the law, or store or share unlawful content (including CSAM, which we will report to the relevant authorities);
- harass, threaten, or endanger others;
- attack, probe, or disrupt our infrastructure or other customers' servers;
- resell the Service or circumvent license enforcement.
We may suspend or terminate servers that violate these rules. Because servers are private and often end-to-end encrypted, we do not proactively read your content — enforcement is typically in response to reports, legal process, or abuse signals at the infrastructure level.
6. Availability, backups, and data retention
- We operate managed servers on reputable cloud infrastructure but do not guarantee uninterrupted availability. The Service is provided "as is."
- Managed servers receive automatic nightly backups (server database and media) retained for a limited window (currently 14 days) for outage recovery. Backups are not an archive service.
- If you destroy your server from the admin portal, its data — including its database and media — is permanently deleted. Use the shut-down option instead if you want to pause a server and keep its data.
- After a subscription ends or a license is revoked, we may delete the server and its backups after a reasonable grace period.
7. Software
We license the IPTinCan client applications to you for personal use with the Service. Self-hosted server software is provided under the license accompanying it. Don't reverse-engineer license enforcement or redistribute builds as your own.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, and our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, or for loss of data beyond the backup commitments described above.
9. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate the Service for breach of these Terms, non-payment, or where required by law. Sections 4, 8, and 10 survive termination.
10. Changes and contact
We may update these Terms; material changes will be posted on this page with a new effective date, and continued use after that date constitutes acceptance. Questions: support@iptincan.com.
